INTRODUCTION

These terms and conditions, between you, the customer ("you", "your"), and Tammy Krings, LLC dba The Conversations That Matter ("us", "we", "our"), govern your use of our website and your purchase, access, download and use of our content and materials ("product", "products"). 

LIMITED LICENSE AND USE

Your purchase of one of our products constitutes our granting to you of a limited, non-exclusive, non-sublicensable, non-transferable license to access, download and use that product provided you: (a) use the content and materials for your personal or internal business purposes only; (b) retain all copyright and other proprietary notices on the content and materials; and (c) do not modify, adapt or edit the content and materials in any way.

You are not allowed to reproduce or create derivative works from any part of our website or our products in any way. You agree not to copy, re-sell, assign, sublicense, rent, share, lend, broadcast, publish, transfer, transmit or otherwise distribute any of our products, whether modified or not, to any third party. You agree not to use any of our products in a way which might be detrimental to us or damage our reputation. Except as otherwise expressly provided in these terms and conditions, you may not copy, distribute, transmit, display, perform, reproduce, publish, license, modify, rewrite, create derivative works from, transfer, sell or in any way exploit any content or material from our website or our products, in whole or in part.

REFUNDS

Due to the nature of our products, you agree that any payments made by you for any of our products are final. You agree that you will not initiate any chargebacks via your payment provider. Any refunds will be at our sole and absolute discretion.

 WARRANTIES AND LIABILITY

 While make every effort to ensure that our products are authoritative and fit for the use of our customers, we take no responsibility for the suitability of the product, and we provide no warranties as to the function or use of the product, whether express, implied or statutory, including without limitation any warranties of merchantability or fitness for particular purpose. Furthermore, we will not be liable to you or any party for consequential, indirect, special or exemplary damages including but not limited to damages for loss of profits, business or anticipated benefits whether arising under tort, contract, negligence or otherwise whether or not foreseen, reasonably foreseeable or advised of the possibility of such damages. You agree to indemnify us against all liabilities, claims, demands, expenses, actions, costs, damages, or loss arising out of your breach of these terms and conditions. 

GENERAL

These terms and conditions constitute the entire agreement and understanding between you and us for our products, and supersede any prior agreements whether made in writing, orally, implied or otherwise. We reserve the right to change these terms and conditions at our discretion.

You agree that monetary damages may not be a sufficient remedy for the damage which may accrue to us by reason of your breach of these terms and conditions, such that we will be entitled to seek injunctive relief to enforce any terms and conditions herein. 

Failure of us to enforce a provision of these terms and conditions will not constitute a waiver of any other portion or provision of these terms and conditions. In the event that any part of these terms and conditions is found to be invalid or unenforceable, the remainder of the terms and conditions will remain valid and enforceable.
